Big question is if someone says they are not playing is that the same as being inactive?

well to be fair they have put it in writing...;P
but it can be taken too many ways to be taken literally,
and therefore you would have to be naive to attack them!

But hey! what a great way to get somebody that you're not fond of,
into some touble though? make them attack you... silly games:(
